You agree that YOUTHFAN is free to use any comments, information, photographs, ideas, videos or other content contained in any User Generated Content posted by you to the Site, or created by you while accessing the Site (including, without limitation, any photographs, portfolio or other materials created or submitted by you on any of the YOUTHFAN Sites), or contained in any communication you may send to YOUTHFAN, or submit to the Site without notice, compensation or acknowledgement to you for any purpose whatsoever, including, but not limited to, developing, manufacturing and marketing products and services and creating, modifying or improving the Site or other products or services.
While YOUTHFAN does its best to ensure the optimal performance of the Site, you agree that you use the Site and rely on material contained in the Site at your own risk.
The Site, and all materials on the Site, are provided "as is" and, to the fullest extent permitted by law, are provided without warranties of any kind either express or implied. This means, without limitation, that YOUTHFAN DOES NOT WARRANT that the Site is fit for any particular purpose; that the functions contained in the materials in the Site will be uninterrupted; that defects will be corrected; that the Site is free of viruses and other harmful components or that the Site is accurate, error free or reliable.

You acknowledge that YOUTHFAN is not liable for any defamatory, offensive or illegal conduct or material found in connection with the Site, including such conduct or material transmitted by any means by any other person.
You acknowledge that YOUTHFAN is not liable for any damages, including, without limitation, direct, incidental, special, consequential or punitive damages, in connection with or arising from your use or from your inability to use the Site.
You agree to defend, indemnify and hold harmless YOUTHFAN, its employees, agents, directors, officers and shareholders, from and against all the liabilities, claims, damages and expenses (including reasonable attorney's fees and costs) arising out of your use of the Site, your breach or alleged breach of this Agreement or your breach or alleged breach of the copyright, trademark, proprietary or other rights of third parties.
This Agreement operates to the fullest extent permissible by law. If any provision of this Agreement is unlawful, void or unenforceable, that provision is deemed severable from this Agreement and does not affect the validity and enforceability of any remaining provisions.
This Agreement shall be governed by, and construed in accordance with, the laws of the Commonwealth of Massachusetts without giving effect to any principles of conflicts of law. You agree to submit to the exclusive jurisdiction of the courts of the Commonwealth of Massachusetts or, if appropriate, the United States District Court for the District of Massachusetts for resolution of any dispute, action or proceeding arising in connection with this Agreement or your use or non-use of the Site, and you further irrevocably waive any right you may have to trial by jury in any such dispute, action or proceeding.

Personal Information: If you register to create a YouthFan account, we ask you certain personal information including your first and last name, user name, email address, password, address, gender and date of birth. In addition, when you visit the Website, our servers will automatically recognize your internet protocol (“IP”) address and if you submit Content, you may, at your option, include information (such as your name or photograph) in the Content that can be used to identify you. All of this information is referred to in this Policy as “Personal Information”.
Web Tracking Information: We, and our third party service providers, may use web tracking technologies such as cookies, web beacons, pixel tags and clear GIFs in order to operate the Website efficiently and to collect data related to usage of the Website and to web and email marketing conducted by us or on our behalf. Such collected data (“Web Tracking Information”) may include the address of the websites you visited before and after you visited the Website, the type of browser you are using, your IP address, what pages in the Website you visit and what links you clicked on, and whether you opened email communications we send to you. Your Child can surf Youthfan.com, view content, and play many games without any Personal Information being collected. We do not collect Personal Information from your Child unless he or she registers on the Website. Typically, your Child will register in order to post content on the Website. The only information we collect from your Child during our registration process is their first name, their Parent's e-mail address, their birth date, member name, and password (“Child’s Personal Information”). We collect birth dates to validate the ages of our guests. We do not collect any other personally identifiable information from your Child during our registration process. We will collect your Child’s e-mail address from you for the purpose of sending your Child e-mail related to youth sports related news and events. For example, we would send a YouthFan newsletter to your Child directly at your request. Note that all websites that are directed to Children are prohibited by law from conditioning a Child’s participation in an online activity on the Child providing more personal information than is reasonably necessary.
If your Child registers for an account, we use your e mail address to notify you of your Child’s registration request. To personalize communications to your Child regarding a specific product, we may use your Child’s first name combined with your last name and a mailing address provided by you when signing up for that specific product. We may collect your Child's e-mail address from you in order to send your Child a newsletter. In addition, your Child’s Personal Information may be collected and used to enable your Child’s participation in certain interactive features such as instant message chatting, sending e-mail, posting on message boards and other similar activities. These activities may involve disclosure of your Child’s Personal Information to third parties. In addition, we may share your Child’s Personal Information with third parties to the extent reasonably necessary to: protect the security of integrity of our sites; to take precautions against liability; to respond to judicial process; or to the extent permitted under provisions of law, to provide information to law enforcement agencies or for an investigation related to public safety.
We send you an e-mail when your Child registers and we provide you 48 hours to refuse your Child's registration. If you refuse to allow your Child’s registration, we will delete your Child's Personal Information from our database. If we don't hear back from you, we will assume that it is acceptable for your Child to be registered. Once you permit your Child to register, your Child will be able to youthfan.com products without any further notification to you.
We collect your Child’s Personal Information when he or she participates in activities such as one to one instant message chatting. Before allowing your Child to use these features, we send an e-mail to you requesting your affirmative consent to your Child’s participation. If you respond by e-mail and give such consent, we then follow that communication with an e-mail confirmation to you and will allow your Child to participate in the activity.
Before allowing your Child to use a feature of our Website that might result in the public disclosure of your Child's Personal Information to third parties on the Internet, such as posting on open message boards, we require a high level of verification to confirm that you have given permission for your Child to participate in such features. For example, we may require you to provide us credit card information, speak to a trained telephone operator or return by postal mail or fax a signed consent form.
